Mindy’s Edibles Deliciously Dosed™ Valentine’s Day Giveaway – OFFICIAL RULES (INSTAGRAM & FACEBOOK)

  • Giveaway description. Mindy’s Edibles Deliciously Dosed™ Valentine’s Day Giveaway (“Giveaway”) begins on January 28, 2021 at 12:01 AM (CST) and ends on February 5, 2021 at 11:59 PM (CST) (“Giveaway Period”) on Instagram & Facebook social platforms. 

The sponsor of this Giveaway is @MindysEdibles (“Sponsor”) on its own behalf. By participating in the Giveaway, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission or processing of Entries and the overall administration of the Giveaway. Entrants should look solely to Sponsor with any questions, comments or problems related to the Giveaway. Sponsor may be reached by email at socialmedia@crescolabs.com during the Giveaway Period. 

  • Eligibility. Open to legal consumers, twenty-one (21) years of age or older, who are residents of IL (“Entrant”). Void where prohibited. Sponsor, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising, and Giveaway agencies and each of their respective officers, directors, and employees (Giveaway Entities) are ineligible to enter win a GP Pack or Prize Pack. Household Members and Immediate Family Members of such individuals are also not eligible to enter or win. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, stepparents, legal guardians, children, stepchildren, siblings, stepsiblings, or spouses. 

 

  • Prizes. Two (2) Grand Prize Winners will receive a @Mindy’sEdibles Grand GP Pack (“GP Pack”) with the approximate retail value (the “APV”) of $592, containing the following items:  
  • $500 Visa Gift Card, and 
  • A Mindy’s Swag and Influencer Kit (APV $92) 

Nine (9) additional winners will receive a @Mindy’s Edibles Prize Pack (“Prize Pack”) with the approximate retail value (the “APV”) of $92, containing the following items:  

  • Mindy’s Edibles Influencer Kit.  
  1. Only one GP Pack or PGP Pack or Prize Pack per person and per household will be awarded. GP Pack or Prize Packs cannot be transferred, redeemed for cash, or substituted by winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute GP Pack or Prize Pack of equal or greater value if a GP Pack or Prize Pack described in these Official Rules is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the GP Pack or Prize Pack represents Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the GP Pack or Prize Pack turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety, or performance of any GP Pack or Prize Pack awarded. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen GP Pack or Prize Pack items. 

The Giveaway is open to legal consumers, twenty-one (21) years of age or older who are residents of IL and the GP Pack or Prize Pack will only be awarded and/or delivered to the addresses within said locations. Void where prohibited. All federal, state and/or local taxes, fees, and surcharges are the sole responsibility of the GP Pack or Prize Pack Winner. Failure to comply with the Official Rules will result in forfeiture of the GP Pack or Prize Pack. 

  • How to Enter. Beginning on January 28, 2021 at 12:01AM CST and ending on February 5, 2021 at 12:00 PM (CST), in order to be eligible to win the Giveaway as described herein, an Entrant must comment on the @MindysEdibles Giveaway Instagram Post  or @MindysEdibles Facebook page post with a comment that meets the following requirements:   
  • Like this post 
  • Tag two friends in the comments below with a (heart emoji)  
  • For 5 additional entries share this post to your story, mention @mindysedibles and mention two friends!  
  • Entrant must follow @MindysEdibles 
  • Any comments or posts must only reflect personal consumption; and 
  • Posts may not contain nudity, profanity, pornography and abide by Instagram Community Guidelines.

By creating and submitting comments on @MindysEdibles Instagram Post or on the @MindysEdibles Facebook page post, meeting the above requirements, Entrant permits to content ownership and use by @MindysEdibles. 

  • Winner Selection. The Winner(s) of the Giveaway will be selected in a random drawing from among all eligible Entries received throughout the Promotional Period. The random drawing will be conducted approximately on February 8th, 2021 by 12:30 PM (CST) after the Promotional Period by Sponsor or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible Entries received. 

 

  • Winner Notification. Winner(s) will be notified by direct message on Instagram approximately on February 5th by 5:00 PM (CST) after the random drawing. Potential Winner(s) must accept a GP Pack or Prize Pack by direct message, or email as directed by Sponsor within 24 hours of notification. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or Winner(s)’s failure to adequately monitor Instagram account. Any winner notification not responded to within 24 hours or returned as undeliverable may result in GP Pack or Prize Pack forfeiture. No substitution or transfer of a GP Pack or Prize Pack is permitted except by Sponsor. Winner(s) will be announced no later than 5:00 PM CST on February 8th, 2021. 

 

  • Privacy. Any personal information supplied by you will be subject to the privacy policy of the Sponsor posed at https://www.mindysedibles.com/privacy-policy. By entering the promotion, you grant Sponsor permission to share your Instagram Account Name for the purposes of administering GP Pack or Prize Pack  fulfillment including a publicly available Winner List. By entering the promotion, you grant Sponsor permission to use other personally identifiable information, such as name and address, for the purpose of administration and GP Pack or Prize Pack fulfillment.  

 

  • Limitation on Liability. Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Promotion; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Promotion; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Giveaway or download of any materials in the Promotion. 

If, for any reason, the Giveaway is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Giveaway in whole or in part. In such event, Sponsor shall immediately suspend all drawings and GP Pack or Prize Pack awards, and Sponsor reserves the right to award any remaining GP Pack or Prize Pack s (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by Sponsor. Sponsor and Released Parties shall not have any further liability to any participant in connection with the Promotion. 

  • Social Network Disclaimers. An Instagram account, Facebook or email account is required to enter. If you do not already have a social media account, visit www.instagram.com or www.facebook.com to create one. It is free to create an account. 
  • This Giveaway is in no way endorsed or administered by or associated with Instagram or Facebook. You understand that you are providing your information to the Sponsor and not to Instagram or Facebook. By participating via the Instagram platform, participants are subject to Instagram data policy and terms of use which can be found at https://help.instagram.com/402411646841720 and https://help.instagram.com/581066165581870. By participating via the Facebook platform, participants are subject to Facebook data policy and terms of use which can be found at    https://www.facebook.com/policy.php and https://www.facebook.com/terms.php. Prize Delivery. After Winner(s) notification and acceptance, the Winner (s) will be asked to provide a current mailing address via direct message on Instagram. The Winner’s name and address will be used for the sole purpose of administration and GP Pack or Prize fulfillment. GP Pack or Prize Pack will be mailed within 5-7 business days following Winner Announcement on February 8th, 2021. Sponsor will pay the actual shipping or handling fees, as such there is no requirement on the Winner to pay shipping or handling.

Erie Suite 110 Chicago IL 60657, socialmedia@crescolabs.com. A request for the names of the winner must be received no later than February 5th, 2021, and after the Merchandise Giveaway has ended. For accessing a Winner(s) List online, visit @MindysEdibles Instagram account after 5:00 PM CST on February 8th, 2021. The winner list will be posted after winner confirmation is complete.
